Guzman Acain LLP Secures Dismissal of Charges for American Client
Our firm successfully obtained an Order of Dismissal in a complex case for our client, a former US Navy serviceman. He was accused of rape, violation of RA 7610 (Child Abuse Law), and acts of lasciviousness at the Regional Trial Court of Olongapo City (Branch 73) presided by Judge Renato Dilag.
The charges stemmed from allegations made by his estranged Filipino wife in 2001, on behalf of her minor daughter from a previous relationship. Our client consistently denied the accusations, maintaining they were fabricated in retaliation for a separate nullity of marriage case he had filed.
Guzman Acain LLP stepped in to represent the accused in 2005 after his previous Olongapo City defense team. Law Firm co-founding partner – Alexander Llanes Acain, Jr. promptly challenged the case’s lengthy delays, citing a violation of the accused right to a speedy trial. Court records revealed the case had been postponed 32 times, with the prosecution failing to present any evidence or witnesses since its filing. Through the law firm’s intervention, the accused achieved a just resolution, finally seeing the case dismissed.
